    Terms & Conditions 

    Eligibility to Bid
    Sale is subject to Seller acceptance. Bidders must read and sign these Terms, provide verification of $25,000 in available funds, and present valid government-issued identification. The highest bidder shall execute the Agreement of Sale at the auction site and pay a $25,000 deposit by cash, certified check, cashier’s check, or treasurer’s check payable to the Title Company/Escrow Agent. The deposit must be increased to a total of 10% of the purchase price within 72 hours by certified funds or wire transfer. The balance of the purchase price, plus adjustments, is due by certified funds or wire transfer within 45 days of Agreement execution at the Title Company’s office unless otherwise agreed in writing. Time is of the essence.

    Title and Deed
    Seller shall convey title by Bargain and Sale Deed in recordable form. Buyer shall pay all recording fees. Real estate taxes shall be prorated at closing. The property is sold “AS IS, WHERE IS.” The Auctioneer makes no representations or warranties regarding deed restrictions, title, zoning, surveys, condition, or taxes. All bidders are responsible for conducting their own due diligence, and all marketing materials are for informational purposes only.

    Default
    If Buyer fails to close or otherwise breaches the Agreement, the Auctioneer may declare a default and retain all deposits as liquidated damages. If Seller is unable to convey title, Buyer’s sole remedy shall be return of the deposit, and both parties shall be released from further obligations.

    Transaction Broker Disclosure
    The Auctioneer/Broker acts as a transaction broker and neutral facilitator. No agency or fiduciary relationship exists unless established by separate written agreement. The Auctioneer/Broker shall present offers, transmit documents, coordinate the transaction through closing, exercise reasonable skill and care, deal honestly and fairly, account for escrowed funds, and disclose known material facts not readily observable that may adversely affect the property. The Auctioneer/Broker does not advocate for price or terms, verify condition, dimensions, zoning, title, or compliance, or provide legal, tax, accounting, engineering, or environmental advice.

    Confidentiality
    Price, terms, motivations, and other confidential information shall remain confidential unless authorized, required by law, or necessary to prevent fraud. Public or readily discoverable information shall not be considered confidential.

    Compensation
    A 10% Buyer’s Premium shall be paid by the Buyer to AC AUCTIONS LLC at settlement.

    Integration
    These Terms are incorporated into and form part of the Agreement of Sale executed following the auction.
